Creator Agreement
Working draft pending legal review. It has not been reviewed by a lawyer, and the company details are still to be added.
Version 2026-11-07 · Effective November 7, 2026. This agreement is for filmmaker accounts and sits alongside the Terms of Use and the Community Guidelines. When it changes in a way that matters, the version changes and filmmakers accept the new version before their next upload.
1. Who this is for
This agreement applies to everyone with a filmmaker account, and to every film they upload. A filmmaker account is separate from a fan account, and the two cannot be converted (see the Terms of Use). By creating a filmmaker account, or by uploading a film, you accept this agreement.
2. What you promise about your film
Each time you upload a film you promise that:
- you made it, or you own the rights to it, or you have permission from the people who do, to publish it on Yapflix under the licence you choose;
- everything in it is yours or properly licensed for this use, including music, footage, images, fonts, and any other film or TV material;
- the people who appear in it, or who own what appears in it, have agreed where the law requires, and it does not invade anyone's privacy or reputation;
- it is not studio or brand material, a copy of someone else's film or TV show, or someone else's work uploaded as your own;
- what you tell us about it (title, description, licence, year) is true; and
- it follows the Community Guidelines.
You confirm this with the rights checkbox in the upload flow.
3. Choosing a licence
You choose how your film is licensed to viewers when you upload. Yapflix accepts public domain and CC0, CC BY, and CC BY-SA. We do not accept NonCommercial (NC) or NoDerivatives (ND) licences, or all-rights-reserved films, because Yapflix shows films for coin unlocks and in subscriptions and has to re-encode them for streaming.
- Choose carefully. Creative Commons licences are not something you can take back for copies people have already received under them, even if you later take your film off Yapflix.
- If your film includes other people's Creative Commons material, you must meet its licence terms (including attribution and, for share-alike material, using a compatible licence) and the licence you choose must be one you are allowed to give.
- Public domain means you are sure no copyright applies, or you have dedicated it to the public domain yourself. If you are not sure, do not pick it.
4. The licence you give Yapflix
You keep ownership of your film. You give Yapflix a non-exclusive, worldwide licence to host, store, transcode (re-encode and resize), stream, show and distribute your film on the service, to create thumbnails, preview images and promotional cards from it, and to create and share links to it. This licence is for running and promoting Yapflix. It lasts while your film is on Yapflix and for a reasonable time afterwards while we finish removing it, and it does not stop you from publishing your film elsewhere. Your chosen licence continues to apply to viewers.
5. Credit and attribution
Your account name is the credit line shown with your films. For CC BY and CC BY-SA films it is also the attribution viewers are entitled to, so use your real name or your studio's name. Do not use someone else's name. We show the licence and your credit name with each film.
6. Plans and limits
To publish a new film you need an active filmmaker plan. Plans set the length of each film, the streaming quality and a monthly processing allowance. Uploads over those limits are rejected and are never cut short. Films you already published stay live if your plan ends. The details are in Filmmaker plans and Billing in the Terms of Use, and the current plans are on the plans page.
7. Payouts
Yapflix does not promise that your film will earn money. If we offer a payout program, whether you receive a payout depends on the program's rules, on your eligibility, and on how your films perform; payouts are not guaranteed, and we do not give earnings estimates. If a payout applies to you, it is made through Stripe Connect, and you must complete Stripe's checks and keep your details up to date. We may hold or reverse amounts connected to fraud, refunds or chargebacks, and we may change or end a program going forward. The terms of any program are shown in your account before you opt in.
8. Takedowns and removal
- You can remove your film. Ask us at support@yapflix.com and we take it down.
- Copyright notices. If someone sends us a valid copyright notice about your film, we may remove it and tell you. You can respond with a counter-notice as described in the Copyright Policy. We end the accounts of repeat infringers in appropriate circumstances.
- Our own review. We may decline, limit or remove a film that breaks this agreement, the Terms of Use or the Community Guidelines, or that we are required to remove. The Community Guidelines explain warnings, suspension, termination and appeals.
9. If a claim is made
If your breach of this agreement leads to a claim against Yapflix, for example because you did not have the rights you promised, you are responsible for it as the law and our terms provide. [Indemnity wording: to be drafted by counsel.]
10. Taxes
You are responsible for the taxes that apply to you, including taxes on anything you are paid. We do not give tax advice. Stripe or Apple may collect tax information from you.
11. Age
You must be at least 18 to hold a filmmaker account, or have a parent or guardian who accepts this agreement on your behalf and is responsible for your account. [Minimum age and guardian consent: flagged for counsel, since the rules differ by country.]
12. Version and acceptance record
When you accept this agreement we record the version and the time on your account. When the agreement changes in a way that matters, we change the version above and ask you to accept the new one before your next upload. Questions? Email support@yapflix.com.
